La Justicia suspendió el desalojo del Club Zapiola de Bernal Oeste
La jueza Diana Español dispuso en el día de la fecha la suspensión del desalojo del club Zapiola de Bernal Oeste, previsto para este jueves 15 de diciembre. De acuerdo por lo indicado por la magistrada en el expediente CAFFARENA Y CASTELLANOS JOSE MARIA Y OTRA C/ CLUB SOCIAL Y DEPORTIVO ZAPIOLA S/ REIVINDICACION, la medida rige hasta el 25 de febrero de 2023, donde habrá una nueva audiencia entre las partes, y en la que el Municipio de Quilmes deberá presentar una propuesta concreta para solucionar el conflicto.
“Le agradecemos a la magistrada por esta decisión, que es una alegría enorme; un triunfo de la lucha de los clubes de barrio, de la CD de la institución, de la UNCB y de los dirigentes y vecinos que se comprometieron con el destino del club”, aseguró Diego Indycki, presidente de la filial PBA de la Unión Nacional de Clubes de Barrio, organización que lleva adelante el asesoramiento legal del club desde hace ya más de 4 años.

“La suspensión es hasta el 25 de febrero, por lo que esperamos que este tiempo sirva para abrir una instancia de negociación para encontrar una solución que sea aceptable para todas las partes”, agregó el dirigente.
Fragmento de la resolución de la jueza Español:
II) Suspender la orden de lanzamiento ordenada para el día 15/12/2022. Notifíquese por Secretaría con carácter de urgente (Ac. 4039,, SCBA).
III) Fijar la audiencia presencial del día 25 de febrero del año 20223 a las 09.00 horas, a la cual deberán asistir la parte actora, la parte demandada y la Municipalidad de Quilmes, oportunidad en que ésta última y la demandada deberán traer propuesta y/o propuestas para arribar a una definitiva solución en la causa,
respetando el derecho de propiedad del actor (art.17, C.N.), debiendo todas las partes contar con facultades para dialogar y consensuar el mejor modo de arribar a la solución antedicha. Notifíquese por Secretaría con carácter de urgente (Ac. 4039, SCBA).
